Online store regulations
These regulations define the rules and conditions of providing services electronically on the website www.axonlab.com by Axon Lab sp. z o. o. with its registered office in Warszawa, address: ul. Transportowców 11, 02-858 Warszawa, entered into the KRS business register under number 0000090747, NIP: 5210082828, REGON: 006736179, (hereinafter: “Axon Lab”).

§ 1 Definitions
The following terms used in these regulations mean:
- Civil Code - Act of 23 April 1964 - Civil Code (Journal of Laws 2017.459 consolidated text, as amended);
- Customer or Client - a natural person with full legal capacity, as well as a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who purchases Goods from the Axon Lab in the Store; due to the range of products offered by Axon Lab, this online store does not conduct sales to consumers and they do not constitute Customers under these regulations;
- Consumer - a natural person performing a legal act not directly related to their business or professional activity, referred to in Art. 22(1) of the Civil Code;
- User Account – a subpage of the Website, secured with a password set by the User, on which information about the User and their orders is saved, which allows to obtain information about the status of a given order, order history, as well as order Goods without having to fill out the order form every time;
- Newsletter – an information bulletin sent electronically to Users who express their will to receive it, containing in particular current information about Goods, including new products and promotions;
- Seller or Service Provider – Axon Lab sp. z o. o. with its registered office in Warszawa, address: ul. Transportowców 11, 02-858 Warszawa, entered into the KRS business register under the number 0000090747, NIP: 5210082828, REGON: 006736179
- Regulations – these regulations;
- Store – an online store operating on the Website. Goods purchased in the Store are delivered only within the territory of Poland. Telephone contact with the Store is possible from Monday to Friday from 7:30 a.m. to 15:30 p.m. , except for public holidays;
- Site - internet service operating at the following internet address: www.axonlab.com; The Site is administered by or on behalf of the Service Provider;
- Goods - movable item from the Store’s assortment, which is the subject of a sales agreement between the Seller and the Customer.
- User - internet user, including a Customer, using the Site;
§ 2 Services provided electronically
- The Regulations constitute the regulations for the provision of services electronically within the meaning of the Polish Act of 18 July 2002 on the provision of services electronically (Journal of Laws 2017, item 1219, consolidated text).

The Service Provider provides the following free services electronically on the Website:
a) presentation of Goods from the Seller’s assortment,b) interactive form for placing orders for Goods from the Store,c) Newsletter,d) User Account. - Familiarization with the content of the Website, in particular with the Store’s assortment does not require having a User Account or expressing the will to receive the Newsletter.
- The User may at any time save the content of the Regulations posted on the Website on their device, as well as print it from the Website. At the User’s request, the Service Provider will send them the Regulations in the form of a pdf file to the e-mail address provided by the User.

Technical requirements necessary for cooperation with the IT system used by the Service Provider are:
a) a device with internet access (computer, tablet, smartphone),b) a web browser with JavaScript and cookies enabled - Google Chrome, Internet Explorer, Mozilla Firefox, Opera in the current version or another web browser compatible with them,c) a valid e-mail account of the User. - The User is prohibited from providing content of an illegal nature. The User is obligated to comply with generally applicable legal regulations, good manners and the provisions of the Regulations.
- The Service Provider informs the User at their request, by means of a message sent by e-mail, about the risks associated with the use of any services provided electronically.
- When creating a User Account or using an interactive form to place orders for Goods from the Store, the User is obligated to provide true and accurate information. Providing false or inaccurate information may prevent the order from being fulfilled.
- Complaints regarding services provided by the Service Provider electronically can be submitted via e-mail to the following address: info@axonlab.pl or in writing to the following address . Transportowców 11, 02-858 Warszawa. In the complaint, the User should describe what the complaint concerns, what the complaint is requested, and provide an e-mail address or correspondence address to which the Service Provider is to respond. In the absence of providing this data, the Service Provider will respond to the User at the address from which the complaint was received or the address provided by the User when placing an order or registering the User Account. The Service Provider will consider the complaint without undue delay, and if the User is a Consumer, additionally no later than within fourteen days. In the event of a negative decision on the complaint by the Service Provider, the User will receive a message with the justification for the refusal.
§ 3 Free of charge agreements for the provision of services by electronic means
- The agreement for the provision of the service consisting in the presentation of Goods from the Seller’s assortment is concluded for an indefinite period of time from the moment the User starts using the Site. The User may terminate it at any time, without giving a reason and without incurring costs, with immediate effect by leaving the Site.
- The agreement for the provision of the service of the interactive form for placing orders for Goods from the Store is concluded for a fixed period of time starting from the moment the User starts filling in the form until the end or interruption of its completion. The User may terminate it at any time, without giving a reason and without incurring costs, with immediate effect by leaving the Site.
- The agreement for the provision of the Newsletter service is concluded for an indefinite period of time from the moment the User expresses their will to receive the Newsletter by checking the appropriate box on the Site. Providing an e-mail address by the User is necessary to provide the Newsletter service. The User may terminate the agreement at any time with immediate effect, without giving a reason and without incurring any costs, by sending the Service Provider an e-mail informing them of their intention to resign from the Newsletter to the e-mail address info@axonlab.pl, as a result of which the agreement for the provision of the Newsletter service will be terminated within 14 days from the date of receipt of the e-mail by the Service Provider.
- In order to conclude an agreement for the provision of the User Account service, which is concluded for an indefinite period, the User fills in the data in the registration form available on the Website, and then clicks on the activation link sent by the Service Provider to the e-mail provided by the User in the registration form. In particular, the User sets a password for the account, which is confidential and cannot be disclosed by the User to third parties. Providing the e-mail address, first and last name, mobile phone number, as well as contact and shipping address by the User is necessary to provide the User Account service. The User may terminate the agreement at any time with immediate effect, without giving a reason and without incurring any costs by sending the Service Provider an e-mail informing them of their intention to resign from the User Account service to the e-mail address info@axonlab.pl, as a result of which the agreement for the provision of the User Account service will be terminated within 14 days from the date of receipt of the e-mail by the Service Provider. Termination of the agreement for the provision of the User Account service is irreversible and results in the deletion of previously collected and stored information. After termination of the agreement, the User may at any time enter into a new agreement for the provision of the User Account service.
- Each agreement for the provision of electronic services by the Service Provider concluded for an indefinite period may be terminated by the Service Provider with a 14-day notice period. If the User uses the Site or services in a manner contrary to the law or good practices, the Service Provider may terminate the agreement with immediate effect or temporarily deprive the User of the ability to use the services provided electronically. The Service Provider shall terminate the Agreement via e-mail or in writing to the User's address.
- The Service Provider shall not be liable to the User for any damages for actions taken in connection with the User's violation of the law, good manners or the Regulations.
- The User may use the Website 24 hours a day, seven days a week, all year round, excluding technical breaks consisting of periodic maintenance or securing the Service Provider’s IT system.
§ 4 Content on the Site
- The content on the Site regarding Goods does not constitute an offer, but rather an invitation to conclude an agreement with Axon Lab, in accordance with article 71 of the Civil Code.
- The content presented on the Site, in particular graphic and verbal works, is protected by copyright. The User may not use any content posted on the Site, either in whole or in part, either in original form or in the form of an adaptation, for purposes other than their own personal use. The User may also not otherwise distribute, change, reuse or place on other sites any part of the Site without the consent of the authorized person.
§ 5 Placing orders and sales agreement
- The Customer may place orders for Goods in the Store using the interactive form for placing orders for Goods on the Website or the User Account.
- When placing an order, the Customer should indicate: a) the ordered Goods (name and quantity ordered) by clicking the “Add to basket” button, b) Customer data (name and surname or name and registered office, as well as address, e-mail address, mobile phone number), c) invoice data, d) data of the recipient of the Goods and place of delivery (name and surname or name and registered office, as well as address, e-mail address, mobile phone number), if different from the Customer's data, e) selected method of delivery of the Goods, f) selected form of payment for the Goods, g) click the “Order and pay” button. The Customer using the User Account service does not have to indicate the information from letters b), c) and d) each time because they are saved in the User account.
- Providing the Customer’s or Goods recipient’s data from the subparagraph 2 above is voluntary, but necessary in order to enable the conclusion and performance of the sales agreement.
- After receiving the order from the Customer, the Seller will confirm its receipt by e-mail, indicating the ordered Goods, their quantity, price, method of payment, method of delivery and delivery fee.
- Upon receipt by the Customer of the confirmation referred to in subparagraph 4 above, a sales agreement for the Goods is concluded between the Seller and the Customer. If the conclusion of the sales agreement for the Goods is not possible at the given time, then the Customer, instead of receiving the confirmation referred to in subparagraph 4 above, will receive the appropriate information without undue delay.
- The Customer may make changes to the given order in terms of the delivery address, method of delivery and may resign from purchasing part or all of the ordered Goods, only until Axon Lab has completed the ordered Goods. In the event of withdrawal from the purchase of part or all of the ordered Goods, Axon Lab will immediately, no later than within 14 days of the Customer’s withdrawal, return to the Customer, respectively, part or all of the payment received from the Customer to the bank account from which Axon Lab received the payment or, at the Customer’s request, to another bank account indicated by the Customer. The Customer changes the order by e-mail sent to the following address: info@axonlab.pl, in which they will provide the order number and the scope of the change that the Customer would like to make. The Customer may also inform Axon Lab about the intention to change the order by calling the telephone number indicated on the Website. If a change to a given order is possible, Axon Lab will inform the Customer about it.
- Invoices will be sent electronically to the e-mail address indicated in the Customer’s account or indicated in the order placement process for purchases without registration.
§ 6 Personal data
- Information required by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: “GDPR”) is provided to the User when obtaining his/her personal data.
- The administrator of your personal data will be Axon Lab. The Administrator conducts operations to process your personal data.
- The basis for the processing of your personal data will be Article 6 paragraph 1 letter b) of the GDPR. The processing of personal data is necessary for the performance of the contract concluded with Axon Lab for the provision of services by electronic means, to which given person will be a party. The purpose of processing personal data is to perform the contract.
- Providing personal data is a condition for concluding the contract and its performance. You are not obliged to provide your personal data, but without providing them, Axon Lab will not be able to enter into an agreement with you.
- The recipients of your personal data may be our suppliers such as: couriers, entities providing accounting services to Axon Lab, device installers, persons performing service and repair activities of devices, entities providing legal services to Axon Lab, entities providing IT services to Axon Lab.
- The period for which data will be stored is not possible to determine, but we can indicate that it depends on your decision and will end when the agreement for the provision of services by electronic means is terminated.
- You have the right to request from the Administrator access to your personal data, its rectification, deletion or restriction of processing, and the right to transfer personal data.
- You have the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office.
- We do not make decisions in an automated manner.
§ 7 Final Provisions
- The Service Provider may change these Regulations. The pending (future) regulations will be posted on the Site next to the current Regulations with an indication of the date of entry into force, with at least 10 days having to elapse between posting on the Site and entry into force. The provisions in force on the date of conclusion of the agreement shall apply to actions taken before the change in the Regulations.
- The Service Provider and the User who provided the Service Provider with their e-mail address are obliged to inform each other about changes to their contact e-mail addresses, unless the new e-mail addresses are known to them or are available on the Site. In the event of failure to inform about the new e-mail address, the message sent to the last known e-mail address shall be deemed delivered. However, this provision cannot lead to the imposition of new obligations on the Consumer.
- Agreements are subject to Polish law. However, the choice of Polish law does not deprive the Consumer of the protection granted to him under the provisions that cannot be excluded by agreement, under the law that would be applicable in the absence of a choice of law.
- In any disputes that may arise in connection with the agreement for the provision of services by electronic means, concluded between the Service Provider and the User, the common court with jurisdiction over the registered office of Axon Lab shall have exclusive jurisdiction.
